This agreement constitutes a legally binding contract between Gambuu (Pty) Ltd ("we," "our," or "us") and any individual or entity accessing the platform ("you," "your," or "User").

2. Definitions

To ensure clarity and avoid ambiguity, the following terms used in these Terms and Conditions are defined as follows:

2.1 Platform

The Gambuu website, tools, and associated services that facilitate interactions between Clients and Consultants.

2.2 Client

Any individual or entity seeking advice, services, or consultations via the Platform.

2.3 Consultant

Any individual or entity offering professional advice, services, or consultations to Clients through the Platform.

2.4 Session

A live, one-time video consultation or engagement facilitated via the Platform.

2.5 Content

Any text, images, videos, audio, or other materials uploaded, shared, or communicated by Users, including but not limited to profiles, feedback, and session discussions.

2.6 User

Any individual or entity that accesses or registers on the Platform, including both Clients and Consultants.

2.7 Malicious Software

Any code or software designed to disrupt, damage, or gain unauthorized access to systems, including but not limited to viruses, worms, or trojans.

2.8 Fraudulent Activities

Any act of deception, including misrepresentation of identity, qualifications, or information, aimed at obtaining an undue advantage.

2.9 Disputes

Disagreements or conflicts arising between Users or between a User and Gambuu regarding services, payments, or use of the Platform.

3. Eligibility and User Registration

3.1 Age Requirements

To register and use Gambuu, Users must meet the following age requirements:

  • Minimum Age: Users must be at least 12 years old to access the platform.
  • Parental Consent: For Users under the age of 18, parental or legal guardian consent is required.

3.2 Verification Process

To ensure the integrity of the platform, Gambuu reserves the right to verify User information at any time. Users may be required to:

  • Provide accurate and complete personal details during registration
  • Submit proof of identity, age, or qualifications when requested

1. Client Services:

  • Clients can browse and book live video consultations with Consultants specializing in various fields
  • Clients can access personalized services and expert advice from Consultants

2. Consultant Services:

  • Consultants can list their expertise, set fees, and offer professional services to Clients via the platform
  • Consultants can manage bookings, communicate securely with Clients, and receive payments for completed services

4.2 Gambuu's Role as an Intermediary

Gambuu acts solely as a facilitator of interactions and transactions between Clients and Consultants:

  • Gambuu is not a party to any agreement, contract, or service arrangement between Users
  • Gambuu does not endorse or guarantee the quality, accuracy, or outcomes of any Consultant's services

5. User Responsibilities

By accessing or using the Gambuu platform, all Users agree to adhere to the following responsibilities and standards of conduct.

5.1 General Conduct

  • Use the platform lawfully and ethically
  • Respect the rights and dignity of other Users
  • Ensure that all shared content complies with applicable laws

5.2 Prohibited Actions

  • Misrepresentation of identity or qualifications
  • Conducting transactions outside the platform
  • Engaging in fraudulent or illegal activities
  • Uploading malicious software
  • Creating multiple accounts for deceptive purposes

6. Consultant Responsibilities

Consultants using the Gambuu platform are expected to adhere to professional and ethical standards.

6.1 Accurate Representation

Consultants must provide truthful and detailed information about their qualifications, expertise, and services offered.

6.2 Professional Conduct

  • Deliver services consistent with professional standards
  • Honor confirmed bookings
  • Maintain confidentiality of client interactions

7. Payments, Fees, and Refunds

7.1 Fee Structure

  • Consultants set their own fees for services offered on the platform
  • Gambuu charges a service fee from every completed transaction

7.2 Refund Policy

  • Consultant no-shows

  • Refund requests must be submitted within 24 hours of scheduled session

Disputes should first be attempted to be resolved directly between Users. Gambuu may mediate if direct resolution fails.
